Terms of Service

These Terms of Service (“Terms”) govern your use of Studio by CanvasFab (“Studio,” “we,” “us”), a marketplace for physical artwork prints operated by CANVAS PRINTS BY CANVASFAB LLC, a Florida limited liability company (the “Company”). By purchasing a print, creating a seller account, uploading artwork, or otherwise using Studio, you agree to these Terms.

Studio is the merchant of record for every marketplace sale: you buy from Studio, not from the individual photographer. Studio collects payment, and CanvasFab prints and ships your order. Support, replacements, and refunds all run through Studio.

Studio serves two kinds of users, and different parts of these Terms apply to each:

2. Buying from Studio

When you place an order, you are buying from Studio as merchant of record. Studio sets the checkout total, collects payment through our payment processor (Stripe), and is responsible to you for the order. Prices are shown at checkout in U.S. dollars. Applicable sales tax is calculated and added at checkout where Studio is registered to collect it (currently Florida); orders shipping elsewhere are not taxed.

Each print is made to order. Because prints are custom-manufactured for you, they are generally final sale except as described in Section 5 (Returns, refunds & replacements).

3. Production, quality & shipping

Studio strives for professional print quality. The following are normal characteristics of hand-finished, made-to-order printed products and are not defects: minor variations in color and brightness (including differences between a screen and a print), canvas texture and weave, metal and paper finish, hand-stretching, and trim and wrap tolerance of a fraction of an inch. Cropping to a chosen size or aspect ratio may change how much of an image is visible. A canvas that is not properly stretched, or that shows excessive sagging, is treated as a manufacturing defect under Section 5.

Studio selects the shipping carrier that offers the best combination of cost, reliability, and delivery performance, and may change carriers at any time. Production and delivery times are estimates only and are not guaranteed. Studio is not responsible for delays, loss, or damage caused by events outside its reasonable control, including weather, carrier handling, and other disruptions.

Shipping at launch

Studio currently ships to the United States, including Alaska, Hawaii, Puerto Rico, and U.S. military (APO/FPO) addresses where supported. International shipping may be introduced in the future at Studio’s discretion. Standard buyer orders ship free during our current launch period. Approved Pro (wholesale) accounts are charged freight at checkout.

4. Order messages

At checkout you may include an optional message with your order. We print it on the packing slip and share it with the print shop, and staff may read or edit it while preparing your order. A message you write is not a contract and does not, by itself, create any obligation beyond these Terms; where a production request matters, Sections 3 and 5 govern. Do not include content that violates Section 7. We treat order messages as personal data (see our Privacy Policy).

5. Returns, refunds & replacements

Before printing. You may cancel an order for a full refund (print, shipping, and tax) at any time while it is still in print prep and has not gone to press. Once printing begins, the rules below apply.

Damage or defect. If a print arrives damaged, has a manufacturing defect, is the wrong item, or fails our quality standards, we will replace it or refund it at no cost to you. Report the issue within 7 days of delivery, with a photo of the problem, from your order tracking page. Studio pays replacement shipping.

Change of mind or wrong size. If you ordered the wrong size or simply changed your mind, request a return within 7 days of purchase. You pay return shipping, the item must be returned in original condition, and a refund is issued after inspection. Custom products may be subject to a restocking fee where legally permitted.

For orders that contain several different prints bought in one checkout, a single print can be canceled or remedied on its own without affecting the rest. Studio applies these policies with reasonable discretion for genuine edge cases (for example, mail delays or travel).

6. Selling on Studio (photographers)

Subscription & account

Selling requires an active subscription. You may pause your storefront at any time — your listings stay visible, purchases are disabled, and you can resume without re-uploading anything. If a subscription payment fails, your storefront enters a paused state after a grace period and can be reactivated by resolving billing. Historical orders, payouts, and uploaded artwork are retained through pause and closure as required for orders, support, records, and law.

Your content & the license you grant

You must own, or hold all rights necessary to sell, everything you upload. You represent and warrant that you own, or have obtained all rights, licenses, permissions, and releases needed to upload, display, reproduce, print, distribute, and sell each work you submit — including any third-party intellectual property, trademarks, likenesses, and model or property releases. You agree to indemnify and hold the Company harmless from claims arising out of a breach of this warranty.

By uploading, you grant Studio a non-exclusive, worldwide, royalty-free license to host, store, display, reproduce, resize, crop, convert, create thumbnails and previews of, cache, back up, archive, optimize, transmit, distribute, print, manufacture, fulfill, and advertise your listing. This license is revocable when you close your account, except as needed to fulfill existing orders, meet legal and record-keeping obligations, and support prior purchases. Studio may feature publicly listed artwork to promote the marketplace and your listings without additional permission.

You keep your copyright. After a sale, the buyer owns only the physical print, not the underlying image rights.

Pricing, payouts & taxes

You set your own retail prices above a wholesale floor Studio controls, plus a platform fee; your payout can never be negative but may be $0 if you price at the floor. Studio absorbs the cost of Studio-funded promotions and does not reduce your earnings because of them. Payouts are made through Stripe Connect approximately 14 days after an order ships, provided it is not under review or held for a refund/defect claim. You are responsible for your own income taxes on earnings received through Studio; Studio does not withhold taxes, and any required tax reporting should be confirmed with your own advisors.

7. Acceptable content & moderation

You may upload original artwork you own or have the legal right to sell, including AI-generated content where you hold all rights to exploit it commercially. Prohibited content includes: works uploaded without authorization; trademarked logos or branding; protected characters; pro or collegiate sports logos; celebrity likenesses without authorization; political campaign materials; explicit adult content; hate speech; and violent or illegal content. Most commercial fan art infringes third-party rights and is not permitted without explicit authorization.

Studio may, at its sole discretion and without advance notice, remove listings, reject artwork, suspend or close accounts, freeze payouts, or disable storefronts. Alleged copyright infringement may result in immediate removal pending review. Photographers may appeal through Studio support. Buyers who print their own photos are responsible for holding the rights to the images they upload.

8. Copyright & DMCA

Studio respects intellectual property rights and responds to notices of alleged infringement. Copyright complaints are received by Studio (not by any individual photographer). Send DMCA takedown notices to dmca@canvasfab.com. Our process is: complaint received → content removed → the creator may submit a counter-notification → Studio evaluates → content is restored if legally appropriate. Studio will register a DMCA agent with the U.S. Copyright Office.

9. Fraud, risk & account actions

Studio may delay payouts, suspend accounts, freeze funds, or investigate transactions where it suspects fraud, chargebacks, abuse, policy violations, or other suspicious activity.

10. Disputes & Studio’s authority

Studio has final authority over refunds, replacements, chargebacks, moderation decisions, marketplace disputes, account actions, policy enforcement, and the interpretation of these Terms. Studio may add, remove, modify, or discontinue features, services, pricing, fulfillment methods, and policies at any time, and may expand into additional products and services over time; these Terms should be read broadly enough to cover that evolution unless expressly superseded.

11. Disclaimers, liability & governing law

Except as expressly stated in these Terms, Studio provides the marketplace and products “as is” and disclaims all warranties to the fullest extent permitted by law. To the maximum extent permitted by law, the Company’s total liability arising out of or relating to an order or these Terms is limited to the amount you paid for the order at issue. Nothing in these Terms limits liability that cannot be limited under applicable law. You agree to indemnify the Company against claims arising from your breach of these Terms or, for photographers, from the content you upload.

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Studio may update these Terms; material changes will be reflected by an updated effective date, and your continued use after an update constitutes acceptance.
